In order to implement the relevant decision-making and deployment of the Party Central Committee and The State Council, resolutely curb the cheating of tanker, severely crack down on illegal acts such as metering cheating and tax evasion, protect the legitimate rights and interests of consumers, prevent the loss of national tax revenue, and promote the high-quality development of the refined oil retail industry, August 2023, The General Administration of Market Supervision, together with the Ministry of Public Security, the Ministry of Commerce, the State Administration of Taxation and other departments, carried out a one-year comprehensive treatment of tanker cheating special action, through the investigation of a number of key cases, investigate and punish a number of criminals, expose a number of typical cases, select a number of experience practices, form a number of system construction results, establish and improve the long-term mechanism for the comprehensive treatment of tanker cheating. Promote the formation of a pluralistic and co-governance pattern involving the government, industries, enterprises and society.
In response to the people’s concerns about short-weight gas stations, tax evasion and other problems, in accordance with the overall idea of “building and building simultaneously, treating systematically”, we have coordinated the current and long-term, comprehensive and focused, rule of law and wise governance, adhered to the liquidation of stock and curbing the increase at the same time, and steadily and orderly promoted the comprehensive management work. Since the launch of the special action, with the joint efforts of all relevant departments and all sectors of society, the governance work has achieved important results, and a total of 1,249 cases of tanker cheating have been investigated and handled nationwide, involving 2.02 billion yuan and 697 million yuan in fines; To investigate and punish taxes, impose additional late fees, and impose a fine of 1.961 billion yuan; 84 criminal cases were filed and 200 people were detained, effectively standardizing the order of the refined oil retail market.
First, the whole chain of efforts to crack down on illegal acts. In view of the current technology, teamwork, chain and other characteristics of the tanker cheating, the organization around the key, gang, chain, dig the source, find the line, and check the leak hole, and build a full chain high-pressure situation of “investigating a case, investigating a number of subjects, regulating the global market”, forming a strong deterrent and warning, and making every effort to curb the frequent occurrence of tanker cheating. Since the special action, the General Administration of Market Supervision, together with the Ministry of Public Security and the General Administration of Taxation, has organized a full investigation of more than 3,800 clues in illegal cases found in two campaigns against the tanker cheating cluster; Listed to supervise the case of a manufacturer in Henan suspected of producing and selling cheating refueling machines, and organized more than 3,000 clues found in centralized verification around the country. In order to comprehensively consolidate the achievements of the special governance, the General Administration of Market Supervision revised and issued the national standard GB/T 9081-2023 for Motor vehicle fuel refueling machines, the Type Evaluation Outline for fuel refueling Machines, the measurement Verification Regulations for fuel refueling machines and other metrology technical specifications. Strengthen the anti-cheating countermeasures of the refueling machine from the aspects of software management, control motherboard, data storage, applying seals, etc., and increase the relevant inspection requirements in the metrological verification work. At the same time, in conjunction with the Ministry of Justice, we will actively promote the revision of the Metrology Law, increase penalties for cheating with measuring instruments, and strengthen legal rigid constraints. The State Administration of Taxation uses new technologies such as big data and cloud computing to establish a risk indicator model for enterprises selling refined oil products, and regularly carries out risk scanning and control; Guangdong, Zhejiang, and Inner Mongolia explored new models of smart regulation and strengthened the foundation of rule of law and smart governance.
Third, make concerted efforts to promote multi-party coordination and governance. It is a complicated system engineering to comprehensively control the cheating work of refueling machine.
